These Terms & Conditions (“Terms”) govern your use of the Pookie Talkie mobile application (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, for your personal, non-commercial use, subject to these Terms.
2. How the Service Works
The App enables push-to-talk voice communication between devices on the same local Wi-Fi network. Connectivity depends on your network and devices, which are outside our control. We do not guarantee that the App will always discover peers, connect, or transmit without interruption.
3. Acceptable Use
You agree that you will not:
- Use the App for any unlawful, harmful, harassing, abusive, or offensive purpose;
- Transmit content that infringes the rights of others or violates any applicable law;
- Record or share other people’s conversations without their consent where such consent is required by law;
- Attempt to reverse engineer, decompile, tamper with, or disrupt the App or the networks it uses;
- Use the App on a network without authorization from that network’s owner.
You are solely responsible for the content you transmit and for complying with all laws that apply to your use of the App.
4. Permissions
The App requests permissions (including microphone) necessary for its features. You control these through your device settings; declining required permissions may limit functionality. See our Privacy Policy for details.
5. Advertising & In-App Features
The App may display advertisements (including rewarded ads) and may offer a free-trial period after which certain features are unlocked by viewing an ad. Ads are provided by third parties; your interaction with any advertiser is solely between you and that advertiser.
6. Intellectual Property
The App, including its name, design, code, and content (excluding your own transmissions), is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks or branding.
7. No Warranty
The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, reliability, or non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.
8. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or related to your use of (or inability to use) the App. The App is not a replacement for licensed radios or emergency communication services and must not be relied upon for emergencies.
9. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it.
10. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a new “Last updated” date. Continued use of the App after changes means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws applicable in your country of residence, without regard to conflict-of-law principles, unless otherwise required by local consumer protection law.
